Maryland Energy Benchmarking & Building Performance Standards

The State of Maryland has the following energy benchmarking and building performance laws for certain large building types.

Fast facts:

  • Starting in 2025, annual reporting requirement. Annual deadline still to be determined.

  • 35,000+ sq. ft. public, commercial, and multifamily properties

  • Additional Requirements: Building Performance Standard starting in 2030

Details

  • Maryland Department of the Environment’s Climate Change Program oversees the development and implementation of the state's plan for reducing greenhouse gas emissions and conducts the state's greenhouse gas emissions inventory. Maryland has set the most aggressive GHG emissions reduction goals in the nation. Under the Climate Solutions Now Act (CSNA) of 2022, a new target has been established at 60% (over the 2006 level) by 2031 and net-zero emissions by 2045.

  • With 3,100 miles of shoreline, Maryland is the fourth most vulnerable state to suffer the effects of sea-level rise associated with climate change. Rising sea levels and increased storm intensity could have devastating and far-reaching impacts on the Atlantic coast and the Chesapeake Bay ecosystem that affect the environmental, recreational, and economic benefits enjoyed by Marylanders and visitors. In general, climate change alters the severity, frequency, or distribution of existing issues that are impacted either directly or indirectly by temperature and precipitation.

  • If you own or manage a commercial or multifamily building of at least 35,000 square feet, you are required to comply. The program is still under development and a due date has not been established yet. Buildings will have to meet an additional Building Performance Standard requirement that will begin in 2030.

  • The state will require building owners to report their energy usage annually via the ENERGY STAR® Portfolio Manager tool, with a to-be-determined due date.

  • All energy utilities including electricity, natural gas, district energy, and any other purchased fuel type used to operate your building.

  • Building owners must report their energy usage data to EPA’s Portfolio Manager, a reporting tool that allows building owners to compare their building’s energy efficiency with similar buildings.
